2023 Legislation

  • 2023 SB 115 – Changing the lists of persons who are required to be given notice of the hearing on a petition for an independent or stepparent, private agency or public agency adoption. See the Judicial Council’s testimony.
  • 2023 HB 2127 - Adjusting time requirements for notice by publication and mailing in the probate code. The original contents of this bill were amended, added to 2023 HB 2130, and passed. See the Judicial Council’s testimony.
  • 2023 HB 2130 - Increasing certain dollar amounts in the Kansas probate code. The original contents of 2023 HB 2127 as amended, regarding the time requirements for notice by publication and mailing in the probate code, 2023 HB 2016, clarifying how property held under a transfer-on-death deed is distributed when one beneficiary predeceases the grantor, and 2023 HB 2018 authorizing the filing of a copy of a will to preserve it for probate, were added to this bill and passed.   • 2023 HB 2131 – Amending K.S.A. 20-2203 and clarifying that the Judicial Council’s mission is to study the administration of justice and make recommendations for improvement. The bill was amended to include the original contents of 2023 HB 2184 and passed. See the Judicial Council’s testimony.
  • 2023 HB 2172 - Enacting the uniform trust decanting act. The original contents of 2023 HB 2144, authorizing modification of a noncharitable irrevocable trust to provide that the rule against perpetuities is inapplicable and providing that the Kansas uniform statutory rule against perpetuities is inapplicable to trusts under certain circumstances and modifying the definition of resident trust in the Kansas income tax act, was added to this bill and passed.   • 2023 HB 2184 - Abolishing the judicial council fund; transferring all moneys and liabilities of such fund to the state general fund; repealing the transfer of funds from docket fees to the judicial council fund; and transferring annually unencumbered funds from the publications fee fund to the state general fund. The original contents of this bill were amended, added to 2023 HB 2131, and passed. See the Judicial Council’s testimony.
  • 2023 HB 2185 - Permitting short form notification service and alternative methods of service under the protection from abuse act and the protection from stalking, sexual assault or human trafficking act and clarifying precedence of child-related orders issued under the protection from abuse act.   • 2023 HB 2186 - Modifying the criminal penalties for unlawful voluntary sexual relations and excluding juveniles adjudicated for the offense from offender registration requirements. This bill was jointly requested by the Judicial Council and the Kansas Sentencing Commission. This was one of several bills originating with this report.
  • 2023 HB 2212 - Eliminating offender registration requirements for certain juvenile offenders. This was one of several bills originating with this report.
  • 2023 HB 2213 - Authorizing offenders subject to offender registration to register at one location, creating a mechanism for fees to be waived and creating a mechanism to seek relief from registration requirements for violent offenders. This was one of several bills originating with this report.
