Function:

The Probate Law Advisory Committee monitors the probate code and studies related areas of law. The Committee prepares an annual supplement to the Kansas Judicial Council Probate Forms 3d.

Assignment:

The Committee will report to the 2012 Legislature on 2011 Senate Bill 47 relating to the Uniform Trust Code and 2011 Senate Bill 48 relating to amendments to the Probate Code. The Committee will also study other legislation recommended by the Kansas Bar Association's Real Estate, Probate and Trust Law Section.

The Committee will continue to recommend legislation revoking inheritance rights of ex-spouses upon divorce. The Committee will continue to study asset protection trusts and will undertake studies of the Kansas Independent Administration Act and trust decanting statutes that extend the term of irrevocable trusts.

The Committee will also prepare the 2012 supplement to the Kansas Judicial Council Probate Forms 3d which will be distributed in July of 2012.
